In order to fight deportation, you have to have good moral character. Thus, many people that are considered to be “habitual drunkards” and have conviction such as DUI, may not qualify to stop the deportation. 

Today, a federal appeals court struck down part of this law. They held that the federal law linking drunkenness with poor moral character violates the equal-protection guarantees of the U.S. Constitution.

We still need to wait and see if the government will appeal this decision. If not, people with the same issue may be able to utilize this decision in their deportation case.
